TERMS & CONDITIONS

These Terms & Conditions govern the relationship between photographer Michaela Ďurišová (“Photographer”) and the client (“Client”) regarding photography services, workshops, fine art print sales and newsletter subscription.

1) Photography Services

1.1 Booking & Payment

  • A date is secured upon payment of a deposit (typically 30%).

  • The balance is due on the shooting day or as agreed.

  • Installment plans can be arranged individually and confirmed by a separate agreement.

1.2 Cancellation & Rescheduling

  • Free cancellation/rescheduling up to 14 days before the date.

  • If cancelled within 14 days, the deposit is forfeited.

  • In case of illness/force majeure, a new date can be arranged by agreement.

  • Photographer may reschedule for serious reasons (illness/technical issues).

1.3 Session Conduct & Minors

  • Client agrees to arrive on time and follow the preparation guidelines.

  • Minors (under 18) can be photographed only with a parent/legal guardian present and with a written consent.

1.4 Nude/Art Nude Photography (Sensitive Content)

  • Nude sessions are subject to individual agreement; Client confirms 18+ and signs a specific consent.

  • Materials are processed/archived with strict confidentiality.

  • Any use/disclosure (portfolio, marketing, competitions, exhibitions, print sales, advertising) requires prior written consent by the Client and will be individually discussed—Client’s privacy comes first.

  • Consent may be withdrawn; withdrawal does not affect past uses made under a valid consent.

1.5 Delivery of Photographs & Printed Outputs

  • Only edited images as per the selected package are delivered; RAW/all outtakes are not delivered.

  • Final selection is made via online gallery (typically 3–5 selection rounds if needed).

  • Delivery time: within 3 months from the Client’s final selection (not from the shoot date).

  • Delivery via secure online link; USB on request (extra fee).

  • Complimentary prints per package:

    • 1× A4 print (or as agreed) of each edited image,

    • 1× fine art canvas 60×70 cm (unframed).

  • Pickup at the studio or shipping (postage paid by Client). Each artwork is checked and signed.

  • Add-ons (photo books, extra formats, framing, special materials) available on request (custom quote).

1.6 Dissatisfaction & Complaints

  • The work is an artistic creation tailored in close cooperation with the Client.

  • Subjective dissatisfaction is not a reason for a full refund.

  • If reasonably dissatisfied, an additional re-shoot at 50% of the original price can be arranged (covers team costs: styling, MUA/Hair, set, assistance).

1.7 Copyright, Disclosure & TFP

  • All images are © Michaela Ďurišová.

  • Client receives a license for personal use (prints, social media with credit).

  • Commercial use requires a separate license.

  • Photographer may use images for portfolio, marketing, references, competitions, exhibitions and fine art print sales unless otherwise agreed by the shoot day.

  • For nude sessions, stricter rules apply: every use is pre-discussed and requires written consent.

  • TFP: non-paid collaborations for portfolio; participant receives non-commercial license and credits the photographer; final curation by the Photographer.

2) Workshops

2.1 Registration, Payments, Cancellation

  • A seat is reserved upon payment of the fee/deposit.

  • Cancellation by participant:

    • 30+ days: 100% refund

    • 14–29 days: 50% refund

    • <14 days: non-refundable

  • Transfer to another participant possible upon agreement.

2.2 Conduct & Safety

  • Organizer may reschedule/cancel for serious reasons; full refund provided.

  • Inappropriate behavior (harassment of model/organizer/participants) leads to exclusion without refund.

  • CCTV/security recording may be used strictly for safety and property protection.

2.3 Rights & Materials

  • All materials and know-how are IP of Michaela Ďurišová; copying/commercial use prohibited.

  • Images created by participants are for portfolio use only, not for commercial sale without consent.

3) Fine Art Print Sales

  • Order becomes binding upon full payment or deposit.

  • Usual delivery time 2–4 weeks (subject to production).

  • As custom artwork, no right of withdrawal under consumer law applies.

  • Report shipping damage within 48 hours with photos.

  • Copyright remains with the author; prints are for personal use only unless expressly licensed.

4) Newsletter & Personal Data (GDPR)

  • By subscribing, Client consents to processing (email, name) for sending news, services and offers.

  • Consent is voluntary and can be withdrawn anytime via unsubscribe link in every email.

  • After unsubscribing, data will not be processed for marketing.

  • Data are processed under applicable laws and not shared with third parties except technical email processors.

5) Final Provisions & Operator

By ordering services, attending workshops, purchasing prints or subscribing to the newsletter, the Client accepts these Terms. Photographer may update the Terms; the current version is published on the website.
